Mastering the Markets – MtM Academy Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the MtM Academy platform, community spaces, resources, and membership services provided by MtM Academy (ABN 40 681 084 417) (“MtM Academy”, “we”, “us”, or “our”). MtM Academy is part of Mastering the Markets Pty Ltd.

By accessing or using MtM Academy (including any of its subdomains or community platforms), you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use or access MtM Academy.

We may update these Terms from time to time. If we make material changes that negatively affect your existing rights or obligations, we will provide at least 14 days’ notice by email or through the platform before they take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.

1. Membership Tiers

1.1 MtM Academy offers three membership tiers, each with varying levels of access and benefits:

• Free Membership – Access to limited community spaces, announcements, partner insights, and selected educational resources.
• Silver Membership – AUD $99 per month. Includes access to additional learning materials, live calls, and member-only community spaces.
• Gold Membership – AUD $249 per month. Includes full access to all MtM Academy features, advanced materials, premium live sessions, and exclusive events.

1.2 All prices are in Australian dollars and include Goods and Services Tax (GST). Fees are charged monthly through Stripe unless otherwise stated.

1.3 We may update membership inclusions or pricing prospectively from time to time, providing at least 14 days’ notice of any material changes.

2. Free Access and Trial Policy

2.1 Each non-paying member is entitled to one MtM Academy free access or trial period per calendar year.

2.2 Free access or trial eligibility excludes users who have held a paid Academy membership within the preceding 12 months.

2.3 Duplicate free access or trial sign-ups within the same year may be cancelled or converted to a paid membership at the current rate.

2.4 Unless cancelled before expiry, a trial membership will automatically renew to a paid monthly plan at the prevailing rate. A valid payment method may be required to start a trial.

3. Membership Accounts

3.1 You must be at least 18 years old to hold an MtM Academy account.

3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.3 Account sharing, resale, or use by multiple individuals is strictly prohibited.

3.4 MtM Academy reserves the right to suspend or terminate accounts that are inactive for an extended period, or where we reasonably believe there has been misuse or breach of these Terms.

4. Payment, Renewal, and Cancellation

4.1 All paid memberships are billed monthly in advance via Stripe. Subscriptions renew automatically each month until cancelled.

4.2 Members can cancel their subscription at any time through their account settings. Cancellation takes effect at the end of the current billing period.

4.3 No refunds, credits, or pro-rata adjustments will be issued for partial-month cancellations, unused time, or change of mind.

4.4 It is your responsibility to ensure your payment method is current and valid. Failed payments may result in temporary suspension until resolved.

4.5 We reserve the right to change payment providers or methods and will notify you of any material change in advance.

5. Community Conduct

5.1 Members must engage respectfully, constructively, and lawfully within the MtM Academy community.

5.2 The following behaviour is strictly prohibited: harassment, discrimination, hate speech, threats, spam, self-promotion of external products, or spreading false or misleading information.

5.3 Violations will be managed through a three-strike policy: two written warnings, followed by termination of access upon a third offence. Severe misconduct (e.g., threats, hate speech, or illegal conduct) may result in immediate removal without notice.

5.4 We reserve the right to moderate, remove, or edit posts and comments that breach community guidelines or these Terms.

6. Content and Intellectual Property

6.1 All intellectual property rights in MtM Academy content, including but not limited to videos, documents, text, images, logos, software, and designs, are owned by or licensed to MtM Academy and its licensors.

6.2 You may not copy, reproduce, share, or distribute MtM Academy content without prior written consent.

6.3 By posting or submitting content (e.g., comments, discussions, testimonials) within MtM Academy, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and share that content for the operation and promotion of the platform.

7. Educational Disclaimer

7.1 All MtM Academy content is provided for educational and informational purposes only. Nothing on the platform constitutes financial advice, trading advice, or a recommendation to buy or sell any security or financial product.

7.2 You acknowledge that trading and investing involve risks and that MtM Academy and its affiliates are not liable for any loss or damage arising from your reliance on educational materials.

7.3 Past performance is not indicative of future results.

8. Privacy and Communications

8.1 MtM Academy collects and handles personal information in accordance with its Privacy Policy, available on our Website.

8.2 By joining MtM Academy, you consent to receive administrative, educational, and promotional communications via email, in-app notifications, or SMS. You can opt out of marketing communications at any time.

8.3 SMS communications comply with the Spam Act 2003 (Cth). Each message includes an opt-out option or link.

9. Termination and Suspension

9.1 We may suspend or terminate your access to MtM Academy if you breach these Terms or engage in conduct that, in our opinion, harms the community or reputation of MtM Academy.

9.2 No refunds or credits will be issued for terminated or suspended memberships due to member misconduct or breach.

9.3 You may reapply for membership following termination, but approval is at our discretion.

10. Australian Consumer Law

10.1 Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL).

10.2 To the extent permitted by law, MtM Academy limits its liability for services to, at its option: (a) re-supplying the services; or (b) paying the cost of having the services supplied again.

11. General

11.1 These Terms are governed by the laws of Queensland, Australia, and each party submits to the jurisdiction of the courts of Queensland.

11.2 If any provision of these Terms is found invalid or unenforceable, it will be read down or severed to the extent necessary, without affecting the remaining provisions.

11.3 These Terms constitute the entire agreement between you and MtM Academy and supersede any prior understandings, agreements, or representations.
